協議 / Agreement

  1. 00 [遵守使用條款 / Compliance with the Terms of Use]

    以下「條款和條件」以英文書寫。所有用戶同意並理解英文版本是任何翻譯版本之上的官方「條款和條件」。

    The following "Terms of Use" are written in English. All users agree and understand that the English version is the official "Terms of Use" over any translated versions.

  2. 01 [協議 / Agreement]

    用戶同意在參與商店提供的服務時遵守這些「條款和條件」。在任何情況下,沒有協議都不會提供服務。

    Users agree to comply with these "Terms of Use" when participating in services provided by the store. Under no circumstances will services be provided without agreement.

  3. 02 [用戶條件 / User Condition]

    用戶必須符合以下4個條件。如果用戶未能符合其中任一條件,將不允許使用服務。如果發現用戶在不符合條件的情況下使用服務,用戶承認保險將不適用。

    Users must meet all of the following 4 conditions. If any one of the conditions is not met, users cannot use the service. If it is found that users are using the service despite not meeting the conditions, users acknowledge that insurance will not apply.

    A) 用戶必須持有在日本駕駛的有效駕駛執照或許可證(基於1949年日內瓦公約的國際駕駛許可證、SOFA執照等)。

    A) Users must possess a valid driver's license or permit to drive in Japan (such as an International Driving Permit based on the 1949 Geneva Convention, SOFA license, etc.).

    B) 用戶必須具備足夠的駕駛技能來使用服務。

    B) Users must have sufficient driving skills to use the service.

    C) 用戶必須了解本店與任天堂和/或遊戲「瑪利歐卡丁車」無關。

  4. 03 [遵守交通法規 / Compliance with Traffic Laws]

    用戶必須遵守所有當地交通法規和規定。用戶必須持有在日本駕駛的有效駕駛執照或許可證,並且必須隨時攜帶。用戶必須具備足夠的駕駛技能來駕駛卡丁車。

    Users must comply with all local traffic laws and regulations. Users must possess and carry at all times a valid driver's license or permit to drive in Japan. Users must have sufficient driving skills to operate a kart.

  5. 04 [卡丁車責任 / Kart Responsibility]

    在日本,根據法律,確保卡丁車可操作且沒有違反任何當地交通法規的功能故障是用戶的責任。(例如:側面信號燈、頭燈、尾燈、剎車燈、剎車、加速)

    In Japan, it is the user's responsibility by law to ensure that the kart is roadworthy and free from malfunctions that would violate local traffic laws (e.g., side signal lights, headlights, taillights, brake lights, brakes, accelerator).

  6. 05 [交通法規違規等 / Violation of Traffic Laws, etc.]

    每位用戶將對任何交通違規負責。本店或導遊不對違規產生的任何罰款或費用承擔責任。

    Each user is responsible for any traffic violations. The shop or tour guide is not responsible for fines or fees incurred due to violations.

  7. 06 [未解決的罰款和費用 / Unresolved fines and fees]

    本店可能會對用戶因與地方當局的交通違規而產生的任何未解決罰款或費用進行收費。

    The shop may charge users for unresolved fines or fees incurred regarding traffic violations with local authorities.

  8. 07 [交通事故 / Traffic Accidents]

    如果發生交通事故,用戶必須通知導遊、地方當局和保險公司。

    In the event of a traffic accident, users must notify the tour guide, local authorities, and insurance company.

  9. 08 [未經授權的和解 / Unauthorized Settlement]

    如果發生交通事故,用戶同意不在沒有本店同意的情況下與對方達成和解。本店不對用戶與對方之間的未同意和解協議承擔責任。

    In the event of a traffic accident, users agree not to agree to settlements with the other party without the shop's consent. The shop is not responsible for settlement agreements made without consent between users and other parties.

  10. 09 [卡丁車保險 / Kart Insurance]

    所有卡丁車都已投保以防事故。保險的覆蓋範圍是有限和受管制的。如果發生事故,保險公司將評估事件。此時,用戶必須支付50,000日圓的免責額。如果保險公司評估事故是魯莽駕駛的結果,用戶可能被拒絕承保。

    All karts are insured against accidents. The insurance coverage is limited and regulated. In the event of an accident, the insurance company will evaluate the case. At this point, users must pay a deductible of 50,000 yen. If the insurance company evaluates that the accident was the result of reckless driving, users may not receive compensation.

  11. 10 [卡丁車損壞 / Kart Damages]

    用戶對卡丁車的任何損壞負責。用戶理解本店將收取實際損害費用。涉及保險公司的任何損壞將遵循第9條。本店有權就損害進行索賠。

    Users are responsible for any damage to the kart. Users understand that the shop will charge for actual damages. Damages involving the insurance company are subject to Article 9. The shop has the right to claim damages.

  12. 11 [犯罪活動和組織 / Criminal Activity and Organizations]

    用戶同意他們不是犯罪組織的成員,也未參與犯罪活動。

    Users agree that they are not members of criminal organizations and do not participate in criminal activities.

  13. 12 [轉租卡丁車 / Subleasing Karts]

    除非本店或導遊指定,否則用戶不得允許其他人駕駛或乘坐卡丁車。

    Users may not allow others to drive or ride the kart unless designated by the shop or tour guide.

  14. 13 [商業用途 / Commercial Use]

    租賃時的卡丁車除非獲得本店批准,否則不得用於商業用途(快遞服務、廣告)。

    Rented karts are not permitted for commercial use (delivery services, advertising) without the shop's permission.

  15. 14 [原狀歸還卡丁車並加滿油 / Return Karts in Original Status, and Full Tanks]

    對於旅遊客戶,用戶在旅遊結束後無需負責加油。對於自由租賃,除了必要的維護外,用戶不得在未經本店同意的情況下通過貼紙或安裝設備等方式修改車輛。此外,車輛必須以原狀歸還,用戶必須在歸還前將燃料箱加滿。如果用戶未加滿油歸還車輛,必須支付本店規定的費用。

    For tour customers, users are not responsible for refueling after the tour ends. For freelance rental, except for necessary maintenance, users must not modify vehicles by applying stickers or installing devices without the shop's consent. Furthermore, vehicles must be returned in original condition, and users must fill the fuel tank before returning. If users do not return the vehicle with a full tank, they must pay the fee set by the shop.

  16. 15 [超時政策 / Over Time Policy]

    對於旅遊客戶,此條款不適用。對於自由租賃,用戶承諾在本店規定的地點和時間歸還車輛。如果用戶超過租賃時間,必須獲得本店同意並支付滯納金。

    This clause does not apply to tour customers. For freelance rental, users promise to return vehicles at the location and time designated by the shop. If users exceed the rental time, they must obtain the shop's consent and pay a late fee.

  17. 16 [版權、肖像權和宣傳權 / Copyrights, Portrait and Publicity Rights]

    用戶同意不對與卡丁車使用和提供服務相關的照片的版權、肖像權和宣傳權提出任何索賠。

    Users agree not to make any claims regarding copyrights, portrait rights, and publicity rights concerning photographs related to the use of karts and services provided.

  18. 17 [損害和罰款索賠 / Claims for Damages and Penalties]

    如果用戶違反這些條款和條件,用戶承認將補償本店就損害或違規罰款提出的任何索賠。

    If users violate these terms of use, users acknowledge that they will compensate for any claims made by the shop regarding damages or penalties related to violations.

  19. 18 [店鋪和導遊決定 / Shop and Tour Guide Decision]

    用戶理解本店和導遊有權根據安全風險(魯莽駕駛、不遵守旅遊規則等)暫停個別用戶駕駛卡丁車的權利和權限。用戶將按照本店或導遊的指定歸還卡丁車。

    Users understand that the shop and tour guide have the right and authority to stop individual users from driving karts in response to safety risks (such as reckless driving, non-compliance with tour rules). Users will return karts as designated by the shop or tour guide.

  20. 19 [店鋪免責 / Shop Disclaimer]

    本店不對用戶造成的任何損害承擔責任和/或義務。本店有權暫停、取消和更改向用戶提供的服務。

    The shop assumes no responsibility and/or obligation for any damages incurred by users. The shop has the right to stop, cancel, and modify services provided to users.

  21. 20 [媒體報導 / Press Coverage]

    用戶不得收集與任何媒體發布相關的數據、信息和圖像。用戶不得在未經本店許可的情況下收集數據。

    Users may not collect data, information, and images in connection with media distribution. Users may not collect data without the shop's permission.

  22. 21 [條款和條件的更改 / Changes to the Term and Conditions]

    用戶理解條款和條件可能在未通知或獲得用戶批准的情況下更新。

    Users understand that the terms of use may be updated without notification or approval to users.

  23. 22 [評論價格 / Review Price]

    我們相信與他人分享和討論旅遊體驗是旅行的真正樂趣之一。因此,為了鼓勵賓客與家人分享他們的體驗、在部落格上撰寫相關內容或在社群媒體上發布,我們提供評論價格方案。當使用者表示願意分享其體驗時,即可享有此評論價格。
    由於不分享體驗的情況極為罕見,因此除非使用者明確拒絕,否則此評論價格將自動適用。
    (我們不會驗證是否實際發布了評論或分享了體驗。符合資格的條件僅僅是表明"願意分享體驗"。)
    然而,某些社群媒體平台,例如 TripAdvisor 和 Google,禁止撰寫評論以換取折扣。因此,此折扣不適用於這些平台。
    如果您因任何原因不希望分享您的體驗,請告訴我們。我們將為您提供一般價格。如果您要求,我們將對您的體驗保密。

    We believe that sharing and discussing travel experiences with others is one of the true joys of travel. Therefore, to encourage guests to share their experiences with family, write about them on blogs, or post on social media, we offer a review price program. This review price applies when a user indicates their willingness to share their experience.
    Since cases where experiences are not shared are extremely rare, this review price is automatically applied unless user specifically decline it.
    (We do not verify whether a review was actually posted or the experience shared. The qualifying condition is simply indicating user's "willingness to share the experience.")
    However, some social media platforms, such as TripAdvisor, Google, prohibit writing reviews in exchange for discounts. Therefore, this discount does not apply on those platforms.
    If for any reason you prefer not to share your experience, please let us know. We will provide you with the regular price. And if you request it, we will keep your experience confidential.
